Can a woman make the pilgrimage without her husband’s permission ?

If it is an obligatory pilgrimage, she may do it without her husband’s permission, as he has no right to stop her. If it is an optional pilgrimage, she should not undertake it without his permission.

In al-Mughni (5/35) Ibn Qudama (May Allah have mercy on him) says: One has no right to prevent his wife from performing the obligatory pilgrimage. This is the opinion of an-Nakha’i, Ishaq, Abu Thawr and the followers of the personal opinion. This is also the correct opinion of the two opinions attributed to Ash-Shafi’i. For it is an obligatory prescription just like the Ramadan fast and the five prayers. Therefore, the husband should not prevent her from doing so. However, according to Ahmad, she must ask for his permission. If she obtains it, she should carry out her plan. As for the supererogatory pilgrimage, the husband has the right to forbid it to his wife.

Ibn al-Moundhir said: There was a consensus among all those from whom I received religious knowledge about the right of the husband to prevent his wife from performing a supererogatory pilgrimage. For respecting the husband’s right is a duty. And it is not permissible for the wife to neglect it for an act that is not obligatory.

Shaykh Ibn Uthaymin (May Allah have mercy on him) was asked in these words  Is it a sin for the husband to prevent his wife from performing the pilgrimage?

His answer was: « Yes, it is if he prevents his wife from performing the pilgrimage when she is eligible. This would be the case if she said: Here is my legal companion, my brother who is going to make the pilgrimage with me. And I have the travel expenses and I am not asking you for a penny. If she has not already made the obligatory pilgrimage, he must give her permission. Otherwise, she can do without it, unless she is afraid of being repudiated. In that case, she is excused. »
